Affiliate Program Terms and Conditions

The Affiliate Program Terms and Conditions are take immediate effect for new affiliates and are due to take effect from October 21st, 2019 for affiliates registering prior to September 20th, 2019. By participating in the Affiliate Program, you agree to abide by the following agreement:

Overview

The following agreement covers users' participation in the Hypnotic World Affiliate Program in order to generate referral commission, and the conditions for such participation.

Definitions

This agreement includes the use of the following terms:

• "We/Our/Us/Hypnotic World" - Hypnotic World Ltd.
• "Affiliate(s)" - User(s) registering to participate in the Affiliate Program.
• "Affiliate Program" - The Hypnotic World Affiliate Program.
• "Affiliate Content" - Content, including links, generated in the Affiliate Area for use on the Affiliate's website.
• "Affiliate Link" - A link to the Hypnotic World website which includes an affiliate tracking mechanism.
• "Affiliate Area" - An area of the Hypnotic World website for affiliate management (homepage at https://www.hypnoticworld.com/affiliates/).

Usage

Participation in the Affiliate Program is subject to both the Affiliate Terms and Conditions and the Hypnotic World Terms of Use.

Affiliates may embed HTML code generated in the Affiliate Area in pages on the website listed in their Affiliate Program account in order to refer users to the Hypnotic World website (www.hypnoticworld.com).

Content Requirements

Affiliate Content may only be used to promote the referral of visitors to the Hypnotic World website. It may not be used for any other purpose, or on websites which contain:

• Defamatory, libellous, offensive, racist, sexist or otherwise discriminatory content
• Content which promotes, incites or advocates violence or hatred of any kind
• Content which is pornographic or which could cause offense to viewers
• Spam, misleading or dishonest information
• Content which contravenes any applicable laws

Links may not be used:

• On websites or advertisements which use the Hypnotic World trademark in their website domain name, or in a manner which suggests, implies or may be reasonably interpreted to indicate our endorsement, ownership or management of the web page or advertisement hosting the link(s).
• In web pages or software which automatically generate an affiliate referral cookie without referring users through an Affiliate Link
• In advertisements which are displayed on search engine results pages for search queries which include the "Hypnotic World" trademark.

Payment

When a user of the Affiliate's website clicks on an Affiliate Link to the Hypnotic World website and, maintaining a referral cookie in their web browser, completes a purchase for a qualifying product, the latest referring Affiliate shall receive the commission provided that the sale:

• Contains products which have been assigned an affiliate commission level (including, but not limited to, hypnosis scripts, MP3s and CDs)
• Is the first payment of a subscription (where the sale is part of a recurring subscription)
• Is not refunded or partially refunded
• Is not cancelled as a result of our fraud prevention efforts

Affiliates will receive payment of commission that has been earned through the Affiliate Program on a monthly basis provided that their earnings have reached the minimum payout threshold of 10.00 GBP since the last payment. Should earnings not meet the payout threshold, they will be carried over to the next payout.

Payouts shall be made to the Affiliate to either the PayPal account provided or by cheque. Where applicable, the Affiliate shall be responsible for any processing fees imposed by third parties as a result of receiving payment via their chosen method.

Affiliates shall provide Hypnotic World with advance notice in writing of any changes to their chosen payment method.

Hypnotic World reserves the right to suspend or recall payments where we have reason to believe that commission has been generated in a way that does not meet the requirements of the Affiliate Terms and Conditions.

Termination

Either Hypnotic World or the Affiliate may end this agreement at any time by notifying the other party in writing. Upon termination of this agreement, the Affiliate agrees to end their participation in the program and to remove any affiliate links which have been added to websites or other content.

Limitation of Liability

Hypnotic World provides all of its products, content and services on an as-is basis only. To the fullest extent permitted by applicable laws, Hypnotic World makes no representation or warranty, actual or implied, with regards to the fitness for a specific purpose of any kind of such provisions. By using such content and services, the user agrees to ensure that products are suitable for their deployed use and accepts full and sole responsibility for all consequences, including but not limited to loss, personal injury and/or damages, arising from such use.
